1.6 The amount of the purchase as it appears before making the payment on the website is final and includes, among other things, shipping costs as received and a fee that varies from product to product, for the purpose of developing and maintaining the website and the service provided therein.
1.7. Buy54 website is strictly an integration payment system between the buyer and the seller. By making any purchase on the website, the user accepts that when an order is placed through the website, Buy54 website shall actually purchase the product for them from the third parties, including the financial obligations thereto. When the user purchases an item(s) through the website, the user enters into two agreements: namely, 1) an agreement between the user and the partner site regarding the receipt of the product (below are links into the terms of use of the platforms Ebay, AliExpress). 2) an agreement between the user to Buy54 for receiving services and using the website. 1.9. The user hereby confirms that they have been made aware of disturbances that may occur during the use of the website that are directly relate to the operation of the website and/or related to malfunctions that may be caused by a third party, including, companies that provide internet services, companies that provide information storage services and companies that provide internet infrastructure. The user exempts Buy54 from any liability and/or damage and/or loss and/or payment that will be incurred due to the above.
1.10. Buy54 Technologies Limited has the full right at any time to change and/or discontinue any feature and/or characteristic of the website at its own discretion without any obligation to notify the user of this in any way whatsoever.
1.11. The user hereby confirms being of legal capacity and is of sufficient age according to law to create a legally binding contract. The user must be at least 18 years old in order to be able to use the website.
1.12. In any case where the website administrators suspect that a website user is abusing the options on the website and/or suspect that the user is not acting in good faith and/or is not conducting himself in a proper manner, the website owners may delete the user from the website without any need to provide an alert or notification.

- Fees and payments

Their presentation does not constitute a recommendation and/or expression of opinion on the part of the company regarding the nature of the products and/or services, their features and/or nature.
6.4 The user understands and agrees that he will be solely responsible for checking the laws and regulations of Zambia (including customs regulations) before placing the order through the website. For this purpose, Buy54 offers the user to also check the Zambia Revenue Authority website to confirm any import restrictions, import incentives and all other importation regulations and taxes

6.6 Purchase via website When the user purchases and orders items from the partner websites through the website, the purchases are made in front of the international trading websites and the Buy54 website acts as an interface. - Shipping policy, returning products and cancelling orders
7.1 The user hereby confirms that the policy of returning the products and cancelling orders are subject to the policies and laws of the country in which the seller is located.
7.2. It is not possible to cancel the transaction on the website after placing an order including all partner sites for which the website provides services.
7.3 It is the responsibility of the user to pay shipping fees for an item and/or product that is returned to the seller and/or the business and/or partner of the website.
7.4 The Buy54 shall bear no responsibility regarding the truth and accuracy of the use of materials on the website.
7.5 If there is a delay in the arrival date of the order(s) at the address provided at the time of purchase, the User must notify Buy54, which operates the website, in a written message about the delay of the order(s). The delay must be notified no later than 40 days from the date of placing the order(s) if the order was made from the eBay website, and if the order was made from the Ali Express website, a written notification of the delay of the order will arrive from the customer no later than 10 days after the latest arrival time of the product has arrived (Buy54 will open a contact in defence the buyer of the international site if the order has not been received by this time). 7.7 In some cases, products purchased on eBay, Allegro or other international trading sites on the website are not sent directly to Zambia, but go through a third-party warehouse in the USA, Europe or Asia before being transferred to Zambia, and the shipping price shown on the website may not be final. In case of additional costs, the user may request the cancellation of the order and receive a full credit for the cancelled product. In the event of a problem with items that are not sent directly to Zambia, it is not possible to contact buyer protection.
7.8 In any inquiry regarding a defective product/a product received that is different from what was described, the website may ask the buyer to send the product back to the seller in exchange for a full refund, with the shipping cost being at the buyer's expense only. In any case of returning a product to the seller, the shipping cost will be at the buyer's expense, according to the policy of the partner sites.
7.9. Shipping to Zambia is the default when ordering through the website. All products ordered through us are sent to Zambia only.
7.10 After receiving approval to receive a refund from the partner websites for the purchase of item(s), Buy54 will transfer the amount received (according to the same or another currency rate) to the user's account on the website, and the user will be allowed to use the amount received for future uses on the website Buy54.
7.11 In order to make a refund and transfer it to the user's credit card account, the user must go to the balance page and click on the balance credit button. For the avoidance of doubt, a refund will only be given to the user who made the purchase of the items).
7.12. Buy54 does not directly or indirectly bear any responsibility for the refund and/or the amount of the refund received from the partner sites in any case, including refusal, cancellation, follow-up, additional expenses, default, etc.
7.13 Crediting and transfer of the amount to the user's card will be approximately between 10 and 14 days, from the day on which the instruction to transfer the refund was received.

- Service policy
9.1 The service is available for a fee. The payment amount is determined by the sole discretion of Buy54 and will be presented to the buyer when placing the order.
9.2 The service only applies to products ordered together with "Customs Shield" only. Products purchased after that without the addition of "customs protection" in the order, will not be entitled to the benefits of "customs protection ".
9.3 The company will bear the direct and reasonable expenses related to the release of the package by the buyer upon presentation of receipts from the authorities and entities that participated in the release procedure. Buy54 will not pay, and is not responsible for all expenses and/or payments as a result of fines imposed on the buyer and/or expenses related to procedures against the customs authorities, including all legal expenses, court fees, payments to any authority other than the tax authority, customs (including the Standards Institute, the Ministry of Communications, etc.), appeal procedures, etc.
9.4 Buy54 will not bear any losses and/or damages caused to the buyer as a result of the release of the package indirectly, including but not limited to expenses: fuel, public transportation, losses caused due to the delay of the package while waiting for its release from the authorities.
9.5 Buy54 does not perform and/or operate the procedures and/or steps for the release of the package from authorities related to the process of releasing the package or its parts. These procedures are the sole responsibility of the customer.
9.6 Buy54 and its operators, managers, employees and partners are not responsible and/or guarantors for any damage caused to the package and/or product during the release procedure of the package and/or product from the appropriate authorities.
9.7 Customs Shield does not cover costs related to package loss and/or defects. If a package is lost and/or damaged before it has been sent and/or during the shipping procedure, the Buy54 company will not bear the expenses.
9.8 The customs rates that change from time to time appear on the website of the Tax Authority, Zambia Revenue Authority at the following link: https://www.zra.org.zm/. In spite of the aforementioned, the user is solely responsible for the viability of operating the Customs Shield service and Buy54 does not bear responsibility for the viability of using the "Customs Shield " service.
- Limiting the account balance period
10.1 Buy54 reserves the right to limit the period of the balance up to 18 months in which the user is required to use the balance in his account. The Buy54 site will notify the user in advance of the expiration of the balance in his account, and of the steps required to extend the period of the balance in the user's account which will not last more than five (5) years from the date of receipt of the balance.
10.2 The user can view the balance of his account(s) by clicking on the balance button after logging into his account on the website.
- Termination of website terms of use
11.1 The user may terminate the terms of use here at any time by contacting customer service on the website at {'[email protected]'} (Opt-Out) for the purpose of terminating this agreement. After receiving the user's notification of the termination of the terms of use, Buy54 will send the user a confirming message and you will be entitled to close the user's account within 30 days from the date of the confirming message.
